ACT Health found to have discriminated against overseas trained doctor
On 30 June 2016 the Australian Capital Territory, Civil and Administrative Tribunal (ACAT) found the ACT Health priority ranking system used for Intern recruitment was in breach of discrimination legislation. ACT Chief Medical Administrator, Professor Frank Bowden gave evidence at the hearing, stating:

No overseas trained doctor, no matter what their merit or the merit of their university, had any realistic chance of selection and that there were no other relevant options open to Dr Wang in the ACT.”

What does this finding mean for Queensland Health?

Queensland Health ranks all graduates within priority 1 – 7. Priority one (1) candidates are medical graduates of Queensland universities who:

  1. are Australian/New Zealand citizens, or Australian permanent residents; and
  2. have not previously commenced an internship.

Priority one (1) candidates are the only candidates who are guaranteed an Intern position within Queensland. Although this decision is not binding on the Queensland Civil and Administrative Tribunal (QCAT), it does pose some interesting questions that Queensland Health may need to consider in their future recruitment and selection of Interns.
