Through our highly experienced Workplace Relations team, we have the ability and expertise to provide specialised health profession services, advice and advocacy on all industrial, workplace relations and legal matters affecting salaried doctor members of AMA Queensland.
Our Department and legal partner continue to assist members with, but not limited to:
- Industrial disputes
- Payroll disputes
- Matters of bullying and harassment
- Formal grievances
- Medical board matters
- Matters involving the Ethical Standars Unit, Clinical Governance Unit and Workplace Investigations Unit
- Matters before the Health Quality and Complaints Commission, Crime and Misconduct Commission, and the Health Practitioners Tribunal
We are also heavily involved in protecting the legal and legislative interests of salaried doctors by working with the State Government on matters including the draft legislation for Mandatory Reporting of misconduct and National Registration and Accreditation.
Queensland Health Employees
Doctors in the public hospital system have their terms and conditions governed by an underlying industrial Award, and a Medical Officer Certified Agreement. The two medical officer only Agreements ratified by the Queensland Industrial Relations Commission on 5 December 2005, are:
- Medical Officer's (Queensland Health) Certified Agreement (No. 1) 2005
- Medical Officer's (Mater Misercordiae Public Hospitals Brisbane) Certified Agreement (No. 1) 2005.
The terms and conditions in both Agreements are identical, with the exception of a differing superannuation clause contained in the Mater Hospitals Agreement as well as no rural and remote incentives clause.
As stated above, AMA Queensland members may seek assistance and representation if subject to a Queensland Health investigation, or you can seek assistance to formalise a complaint of workplace harassment. Whatever your industrial or legal need, department staff will assist where possible.
Visiting Medical Officers (VMOs)
While still employees of Queensland Health, the terms and conditions for VMOs is governed by the 2005 VMO Agreement. This Agreement is negotiated by Queensland Health and AMA Queensland’s VMO Committee every three to four years, and was finalised in October 2005.
VMOs can also be engaged by Queensland Health, or other health facilities, as Independent Contractors. AMA Queensland can assist members seeking advice on, or the interpretation of, the contents of a Contractor Agreement. Members can also forward a copy of any such agreement to AMA Queensland for their review and feedback.
